The offering of condominiums for sale and the acceptance of an offer to purchase a condominium can only be made in connection with the delivery to a prospective buyer of a Conditional or Final Subdivision Public Report and delivery of the project documents approved by the DRE for the offering.

The DRE review of the developer’s application and required filing materials includes, but is not limited to, the terms and conditions of the proposed offering, the condition of title, the status of blanket liens on the project, security arrangements to assure project completion, access from public streets, the availability of sufficient water service, utilities, public schools and other public services and improvements for the proposed development, and acceptable documents and provisions for establishment of one or more owners’ associations to manage and operate the project.

The complete offering terms for the first and second phases of the project are available for review by prospective buyers and have been authorized by the DRE to be used for entering into purchase agreements. Purchasers interested in entering into a contract to purchase a condominium in the first and/or second phases of the project should obtain a copy of the Final Subdivision Public Report, for additional information about the project. No federal agency has judged the merits or value, if any, of this project.

The diagrams and drawings of the first and second phases of the project on this site are artist’s renderings and are conceptual only. Maps, floor plans, models and other improvements represented, are not to scale or shown in their final as-built locations and orientations. The developer expressly reserves the right to make such modifications, revisions, and changes in the design of the project and the buildings and condominium units therein, that it deems desirable in its sole and absolute discretion or as may be required by law or governmental bodies. All features, specifications and plans are subject to change without notice. Dimensions and square footages are approximate only, based upon initial architectural drawings, and may vary with actual construction of the project and redesign of the size, orientation and locations of the units and other building elements.

Any views represented in the materials on this site are also preliminary and are subject to be changed or eliminated in the final construction of the project. Views shown cannot be relied upon as the actual view from any particular unit within the project. Views will differ depending on conditions such as location, skyline, and weather. Prospective purchasers should be aware that any view from the unit and the remainder of the project may in the future be limited or eliminated by construction of buildings on adjacent or neighboring properties. Developer hereby gives notice to prospective purchasers that developer in no manner guarantees the continuing existence of any view from any particular unit in the project. Interior photos shown depict model units with designer elements, options and upgrades that may or may not be available for purchase by a prospective buyer, and are not representative of the standard features of units as presently planned. CALIFORNIA PRIVACY POLICY

In addition to the information contained in our Privacy Policy, effective January 1, 2020, the following is specific to California residents. The California Consumer Privacy Act (“CCPA”) provides California residents with certain rights regarding their Personal Information. These rights and the methods for exercising them are described in more detail below. Please note that this section applies only to and the rights described in it can only be exercised by residents of California.

CALIFORNIA INDIVIDUAL PRIVACY RIGHTS

Description of Your Rights If you are a California resident, you have the following rights under the CCPA, upon submitting a verifiable request:

Right to Access Personal Information: you may request access to the categories and specific pieces of personal information we collect about you.

Right to Know: you may request that we disclose the categories and specific pieces of personal information that we have collected about you in the last 12 months, as well as the sources from which personal information is collected, the business and commercial purposes for collecting it, the categories of third parties with whom we have shared it, and the categories of personal information about you that we have disclosed for a business purpose in the last 12 months.

Right to Delete: you may ask us to delete certain personal information we have collected about you, subject to the exceptions provided by the CCPA.

Right to Opt-Out of Sale: WE DO NOT SELL YOUR INFORMATION TO THIRD PARTIES.

Right to Non-Discrimination: You may freely exercise these rights against discrimination (e.g. you will not be penalized) in relation to the exercise of your privacy rights under this privacy notice.

Authorized Requests. Only you, or a person registered with the California Secretary of State that you have authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may, however, make a verifiable consumer request on behalf of your child.

THE SITE IS NOT INTENDED FOR CHILDREN AND WE DO NOT KNOWINGLY SOLICIT OR COLLECT PERSONAL INFORMATION ON THE SITE FROM CHILDREN UNDER THE AGE OF 16. IF WE LEARN THAT A CHILD UNDER THE AGE OF 16 HAS SUBMITTED PERSONAL INFORMATION TO US THROUGH THE SITE, WE WILL TAKE REASONABLE MEASURES TO DELETE SUCH INFORMATION FROM ITS RECORDS AND TO NOT USE SUCH INFORMATION FOR ANY PURPOSE (EXCEPT WHERE NECESSARY TO PROTECT THE SAFETY OF THE CHILD OR OTHERS, AS REQUIRED BY LAW, OR AS MAY OTHERWISE BE REQUIRED BY LAW).

Following a request to know, access, or delete your personal information, we must first verify your identity. We will take commercially reasonable steps to verify your identity, including asking you to provide us with information to confirm your identity.

If you wish to designate an authorized agent to make a request on your behalf, please indicate that when submitting your request.

Responding to Requests. Once we receive and confirm your verifiable consumer request, we will make good faith efforts to provide you with additional information or access to your personal information (either the categories or specific pieces of Personal Information), or delete it when you request it, but there may be circumstances under the CCPA in which we need not comply with your request. For example, we are not required to delete personal information needed to complete the transaction for which the Personal Information was collected or otherwise to provide a service we are contracted to provide, to detect a fraudulent or illegal activity, for bookkeeping or tax purposes, or to comply with legal obligations. Also, we are not required to provide additional information, access, or to delete personal information where your identity could not be verified, where the information would compromise others' privacy or other legitimate rights, like intellectual property rights, or where the information contains any legally privileged material. If we determine that your request should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries.

Timing of Response. Any requests that can be processed by us will be done in no more than 45 days from the date we receive your request, unless we notify you that an extension is required. In case of an extended completion period, we will process your request in no more than 90 days from the date of your original request. For requests that seek the disclosure of specific pieces of information about the consumer, we will select a format that is readily useable and should allow consumers to transmit the information from one entity to another entity without hindrance. Consumers are limited to two requests to know/access their personal information within a 12-month period.

Updates to This Privacy Statement

The “Last Updated” legend at the top of this page indicates when this Privacy Policy was last revised. Any change will become effective when we post the revised Privacy Policy on the Site.
